jb 77DECRETO por el que se expropia por causa de utilidad pública una superficie de 1-02-77 hectárea de temporal de uso parcelado, de terrenos del ejido ＂Las Bajadas＂, Municipio de Veracruz, Ver.
ENRIQUE PEÑA NIETO, PRESIDENTE DE LOS ESTADOS UNIDOS MEXICANOS, en ejercicio de la facultad que me confiere el artículo 89, fracción I, de la Constitución Política de los Estados Unidos Mexicanos, con fundamento en los artículos 27, párrafo segundo, de la propia Constitución; 13 y 41 de la Ley Orgánica de la Administración Pública Federal, y 93, fracción I, y 94 de la Ley Agraria, y RESULTANDO PRIMERO.- Que por oficio número AG/250/11 de fecha 1 de noviembre de 2011, la Comisión Federal de Electricidad solicitó a la Secretaría de la Reforma Agraria, hoy Secretaría de Desarrollo Agrario, Territorial y Urbano, la expropiación de 00-98-66.435 hectárea de terrenos pertenecientes al ejido denominado "LAS BAJADAS", Municipio de Veracruz, Estado de Veracruz, para destinarlos a la construcción de la subestación eléctrica J.B. Lobos y sus obras complementarias, conforme a lo establecido en el artículo 93, fracciones I y VII, de la Ley Agraria, y se comprometió a pagar la indemnización correspondiente en términos de Ley. SEGUNDO.- Que el expediente fue registrado con el número 13540. El núcleo agrario fue notificado de la instauración del procedimiento expropiatorio, a través del Comisariado Ejidal, mediante cédula de notificación de fecha 26 de noviembre de 2012, recibida el mismo día, sin que haya manifestado inconformidad al respecto. Iniciado el procedimiento relativo a los trabajos técnicos e informativos, se comprobó que existe una superficie real por expropiar de 1-02-77 hectárea de terrenos de temporal de uso parcelado, resultando afectada la parcela número 12 asignada al propio ejido. TERCERO.- Que la superficie que se expropia se encuentra ocupada por la Comisión Federal de Electricidad con la subestación eléctrica J.B. Lobos y sus obras complementarias, por tanto, la citada superficie no es susceptible de labores agrícolas, por lo que es procedente que se tramite el presente instr……
